Kapiri Mposhi, April 29, 2019, ZANIS---Kapiri Mposhi Magistrate, Mwila Malupande has convicted a class teacher and 12 grade 12 pupils for examination malpractices.

Haggai Kayuni a class teacher from Kamulobwe School in Kapiri Mposhi was facing two counts while, the pupils were facing a count each of examination malpractices.

In the first count, Kayuni was convicted for disclosure of examination questions contrary to section 18 (1) of the Examination Council of Zambia Act Chapter 137 of the Laws of Zambia.

In the second count Kayuni was jointly charged and sentenced with the 12 pupils for unauthorized possession of examination papers or information contrary to Section 19 (1) of the Examination Council of Zambia Act Chapter 137 of the Laws of Zambia.

Particulars of the offence are that Kayuni on unknown dates but between October and November 2018 did possess examination papers namely science paper two and disclose contents therein to the said pupils using social media.

In mitigation, Kayuni asked for lenience from the court as he was the only bread winner in the family.

But in passing judgment, Magistrate Malupande observed that examination leakages have become rampant and are compromising the education system in the country.

She then fined Kayuni K5, 000 on each count or serve a simple six months imprisonment consecutively stating that, this will deter would-be offenders.

And magistrate Malupande has slapped a K 1, 500 fine or serve a one moth simple imprisonment in default against seven grade 12 pupils convicted of examination malpractices.

The pupils were convicted for unauthorized possession of examination papers or information contrary to Section 19 (1) of the Examination Council of Zambia Act Chapter 137 of the Laws of Zambia.

Magistrate Malupande has however, reserved ruling on five remaining pupils as they are deemed to be juveniles.

She has since ordered for social welfare reports before making a ruling later today. 

Particulars of the offence were that on November 12, 2018 the pupils had in their possession grade 12 science paper two relating to the content of 2018 science final examination without authority.

The pupils accessed the leaked examination paper and information from Kayuni through social media.
