A 28 year old Katete peasant farmer has been sentenced to one year two months imprisonment with hard labour for steal two cases of dragon energy drinks and six castle lager beer altogether valued at K 232. 

 

The sentence is subject to confirmation by the high court.

 Justine Daka of Chibolya compound was found guilty for breaking into a building and committing a felony therein contrary to section 303 (a) and 272 of the penal code chapter 87 of the laws of Zambia.

Facts before court were that Justine on May 5, this year while in Katete did break and enter into Drums Night Club property of Volta Chirwa. 

It is believed that on the material day Daka did steal two cases of dragon energy drinks and six castle lager beer altogether valued at K 232. 

Daka was discovered in the night club around 06 hours by the door bouncer Siame Miti who later alerted his boss on the matter. 

Daka who pleaded with the court on basis of his failing health told the court that as a result of the beatings he was received at the time of apprehension he has sustained injuries in his arm and ribs therefore he could not afford to work if sent to prison.

He however admitted having entered the club by breaking the burglary bars. 

The evidence before court were 12 dragon energy drink canes and 6 bottles of castle lager which were said to have been found near the window the accused used to access entry.

In mitigation Daka pleaded for forgiveness adding that he was a second offender and was not in good health. 

However, Katete Magistrate Prudence Siluka sentenced Daka to one year two months subject to confirmation by the high court.
